Recovering from a car accident can be costly, especially when you have to contend with life-altering injuries. Unfortunately, many car accident victims do not receive the compensation they deserve.
While Florida is a no-fault state, it does allow car accident victims to file civil suits if they’re facing severe injuries. Such was the case for Andrew Pickett Law, PLLC’s more recent client, who put both Andrew Pickett and fellow attorney, Tara Couture, on the case.
Both attorneys represented a plaintiff who, in March of 2018, suffered a life-altering neck injury in a car accident. This injury required surgery and still impacts the plaintiff’s ability to enjoy their life.
Both attorneys had to contend with the complexities of Florida Statute 627.7407, Florida’s no-fault statute, to fight for their plaintiff’s compensation. Fortunately, the attorneys could argue for compensation with Florida’s pure comparative fault rule in mind.
In pure comparative fault cases, a plaintiff’s attorney must calculate both the dollar value of accident-related damages and the percent to which both parties contributed to those losses. Even in cases where the plaintiff receives compensation, the defendant will not be liable for the percentage that courts attribute to the plaintiff.
After three and a half years of deliberation in Brevard County courts, the Pickett and Couture team’s arguments came through. The arguments they made on the plaintiff’s behalf saw the plaintiff awarded a settlement of $1,487,553.51.
The Brevard County judicial system released this decision on October 13, 2021. In a Facebook post discussing the case, Couture said, “Thank you to my trial partner Andrew Pickett for all of his hard work. There is no greater feeling than seeing justice finally served to a very deserving client.”
